Interview mit einem von Apple verklagten ADC Mitglied

Ende Dezember wurde bekannt, dass Apple eine Klage gegen drei ADC Mitglieder (und 25 unbekannte Personen) eingereicht hat, die eine 10.4 Entwicklerversion per BitTorrent verbreitet haben sollen. Im DrunkenBlog findet sich ein äußerst lesenswertes Interview mit einem der verklagten studentischen ADC Mitglieder sowie einem Admin des Torrent-Trackers, über den die Tigerversion verbreitet wurde.

Do you think what you did was wrong?
At the time, no. If I did think what I was doing was wrong, I wouldn't have done it. Looking back on it, realizing that I did break an NDA, and I was part of a scandal involving one of my favourite companies, yes I do think what I did was wrong and I understand why they are suing me. It sucks being the bad guy in a situation, and I honestly do regret what I did. But hindsight as they say is 20/20.

Can you give us some insight into how Apple was able to single out these three individuals from the swarm of seeders and downloaders?
BitTorrent is not anonymous; in order for the protocol to operate it requires a list of 'peers' to connect to. A peer list consists of IP address information for other peers which are interested in the content. From that information, based on what we know, Apple linked IP addresses from the tracker and usernames from the forum to information from Apple's ADC site.

Zu Apples Klage gegen Think 'Nick dePlume' Secret gibt es weitere Reaktionen, so vermengt Forbes die Worte Fans, füttern und beißen und argumentiert, es würde Apples Aktienkurs nicht schaden: "And, the leak certainly hasn't hurt the company's stock price. Since news of the cheap Macs hit on Dec. 28, two investment banks have issued bullish reports on the developments and Apple's shares have risen 33 cents, to $64.55." John Gruber erinnert dagegen an die letztjährige Enttäuschung als der iPod mini dann doch (erheblich) mehr als die vorher lautstark von Think Secret kolportierten 100$ kostete: "I’ve been thinking the same thing could happen again — what if Apple’s plan for next week is to release a cool new “headless” Mac with decent specs, but at a price of, say, $699 or $799? If it had remained a secret, it might have been hailed immediately as a terrific new low-cost Mac. Or what if it is G5-based, but costs $999? If Apple unveils something at those prices Tuesday, the immediate reaction will be that it was “supposed” to have cost $499." Und Michael Gartenberg letztendlich, der schürt das Gerüchtefeuer gegenüber NewsFactor noch ein wenig nach: "It's possible that Apple is doing this to spread misinformation(...) They're making a loud noise, and that could be protecting whatever they're going to say next week," Gartenberg added.

Cringely gibt seine Vorhersagen für 2005 ab, und prognostiziert, dass Apple den 499$ Mac vorstellt und möglicherweise im Preis quetscht: "But what if they priced it at $399 or even $349? Now make it $249, where I calculate they'd be losing $100 per unit. At $100 per unit, how many little Macs could they sell if Jobs is willing to spend $1 billion? TEN MILLION and Apple suddenly becomes the world's number one PC company.(...) And if it doesn't work, Steve will still have $5 billion in cash with no measurable negative impact on the company. Vergangenes Jahr lag Cringely bei Apple nicht allzu richtig, so sagte er Wal-Marts Überwindung des iTMS vorher (die in keinster Weise stattgefunden hat), sowie einen Flash und einen Video iPod (damit dürfte er für 2005 schon richtiger liegen). Und aufs Apple Tablet warten wir ebenfalls vergeblich.

Im 'Bill Gates Filmriss-PowerBook-Trauma'-Posting ist es bereits angeklungen, Gates CES Keynote hatte einige Windows Media Center Spezialpannen zu bieten. Wer sich Conan O'Brians Bösartigkeiten gemischt mit Bill Gates Desastermiene ansehen will, kann sich das 178MB große WMV der Keynote per Torrent ziehen (via Site-9 Weblog). Um zu einer 'ausgewogeneren' Berichterstattung beizutragen, sei der HinterderBühne-Bericht von MSs Sean Alexander zitiert: "In our postmortem, the team thinks one of two things happened- the USB booster failed or two much IR interference on-stage. We tested for this prior and ran into some minor issues with Plasma TVs used for timers and prompters creating interference on another system but Bill's remote control was never an issue - moving the displays fixed the problem. Of course, we didn't have cameras going off regularly with IR autofocus during the runthroughs. The audience can see the pictures but everyone on-stage is seeing thumbnails. Bild von iTunes auf Motorola Handy? [Update_3]

Gefunden bei fryke, Quelle unbekannt.
Update: Bei dem gezeigten Mobiltelefon handelt es sich (soweit erkennbar) um das Motorola E398, das bereits seit Ende letzten Jahres auf dem (europäischen) Markt zu kaufen ist. Momentan ist es in Deutschland wohl nur exklusiv über T-mobile für einen vertragslosen Preis von rund 320EUR zu haben. Das E398 besitzt MP3-Player, Stereolautsprecher, Bluetooth, VGA Kamera und kommt mit 5MB internem und 64MB mitgeliefertem (Trans-Flash)Speicher. Motorola beschrieb es seinerzeit angeblich als "mini iPod that makes phone calls". Vorerst wirft das Bild jedenfalls erheblich unbeantwortete Fragen auf.

Update_2: Das Bild stammt offensichtlich aus dem MacRumors Forum, bzw. wurde dort von 'Patron' gepostet, der dazu anmerkt, dass es sich nur um ein Demogerät handelt, um die Konkurrenz außen vor zu halten. "The motorola CEO said that the company is going to focus on ease of use and design. In this way Apple is the best partner they could get since this is where Apple is best at." (Danke, flynn)

Update_3: Um es nochmal zu unterstreichen: die Bilder sind wohl echt, auch die gezeigte iTunes mobile version ist real, aber das Mobiltelefon ist nur vorläufiges Demonstrationsobjekt gewesen. Unbekannt ist also nach wie vor, auf welchem Motorola Gerät zuerst iTunes mobile zu haben sein wird (im Laufe des Jahres wird es wohl eh auf weitere Motos ausgedehnt). Bisher unbekannt ist die geplante Möglichkeit, nicht nur Handy mit iTunes zu synchronisieren, sondern direkt mobil auf den iTMS zugreifen zu können (davon berichten unabhängig NewsFactor und Gizmodo). Die Produktankündigung des 'iTunes phones' soll im ersten Quartal geschehen (wie wäre es mit dem 11.01.?). Bedient wird via Handyjoystick und

Wie MacCentral berichtet, sollte das Gerät eigentlich auf der Moto-Keynote gezeigt werden, es wurde aber kurzfristig umgeplant, um zu verhindern, dass das Design gleichsam aus dem Webcast geklaut wird (WahrheithinterdenDingenErkenner dürfen sich nun einen Zusammenhang auf den fehlenden MWSF Keynote-Stream zusammenzimmern). AppleInsider munkelt über Prototypen mit 1GB Flash-Speicher und Bluetooth-Streaming-Tauglichkeit.

Mac OS X 10.3.8 geht an die Entwickler [Update]

10.3.8 build 7U3 ist im Umlauf, wie AppleInsider aus Entwicklergeschnatter herausgehört haben will. Die Details sind (noch) spärlich, Systemstabilitätsverbesserungen und Zuwächse bei der Grafikleistung sind jedenfalls zu erwarten.
Update: AppleInsider hat weitere spärliche Details zusammengetragen, das Update wiegt momentan rund 19MB und soll angeblich nächsten Monat veröffentlicht werden:

More specifically, developers said the system update would improved Quartz 2D Extreme performance on PCI devices and deliver a new version of the Mac OS X kernel, said to be 7.8.0.(...) The Panther update is also expected to repair performance bugs associated with Nvidia graphics and OpenGL.

Kein MWSF Keynote Stream? [Update]

Die längst überfällige Ankündigung eines Keynote Streams (bzw. satellite broadcast) war schon ein recht untrügliches Zeichen, nun veröffentlicht Macintouch eine Apple email laut der es weder Satellitenübertragung noch Livestream von Jobs Auftritt am kommenden Dienstag geben soll. Im (zeitlich nicht näher bestimmten) Anschluss an die Keynote soll allerdings die bereits gewohnte Aufzeichnung auf apple.com zu sehen sein.

Update: Gestern zimmerte man sich bei AppleInsider noch einen über die entfleuchten Produktdetails verstimmten jähzornigen Jobs als Keynote-Killer zusammen, heute nun soll schon alles längst klar gewesen sein:

Industry sources claim that preparations for live webcasts with mass appeal typically must be made well in advance of the event. Company sources believe such arrangements were never part of Apple's Macworld to-do list.

Letztes Jahr war immerhin schon Ende Dezember bekannt, dass es eine MWSF Keynote Liveübertragung geben würde. Offizielles zum Thema steht bisher jedenfalls aus (außer man rechnet das bei Macintouch zitierte angebliche Apple Memo als solches).

MacOrama für den 6. Januar 2005

AppleInsider verspricht neue PowerBooks in allerbaldigster Kürze. Es soll nach Quellengesprudel die letzten G4 PowerBooks werden, 15" und 17" mit 1,7GHz und aufgeputschter Grafikkarte, das 12" könnte bei 1,5GHz landen. In der zweiten Hälfte 2005 sollen wir dann endlich das PowerBook G5 zu sehen/kaufen bekommen.

Die PSP ist kein iPod Killer. Gut, das wussten wir auch schon vorher. Unterhaltsam ist Jeremy Horwitz Artikel trotzdem: "Since so many companies now evoke the iPod's name just to get media attention, we've generally opted not to report on "bandwagon" stories. It's especially ironic given Sony's previous Walkman history that the company has needed to use the iPod's name to tout the PlayStation Portable as more than just a super-expensive Game Boy. But in the absence of a video- and game-playing iPod, the PlayStation Portable definitely merits a look from iPodlounge readers with interests in those spheres. Just don't expect a device that's as elegantly implemented, or completely useful out of the box as the iPod."

Techdirt berichtet von der Klage eines amerikanischen iTunes-Nutzes gegen Apple, weil er die Musik nur mit dem iPod nutzen kann. "An 'unhappy' iTunes user is now suing Apple for antitrust violations, claiming that they broke antitrust laws by only allowing their music to play on iPods -- blocking out other music players from the market." Wie Macworld UK von der CES berichtet, plant Hitachi fürs zweit Halbjahr 2005 größere Platten des Typs, der bereits im iPod mini verwendet wird: "At present Hitachi's most capacious Microdrive can hold 4GB of data, but the new drives, due in the second half of this year, will be able to hold between 8GB and 10GB, said Bill Healy, senior vice president of product strategy and marketing at HGST." Nur was ist aus Hitachis für Ende 2004 angekündigter 6GB Variante geworden?

Bill Gates Filmriss-PowerBook-Trauma

Für Bill Gates' CES-Keynote hatte man sich Conan O'brien als "Interviewpartner" ausgesucht, um das ganze etwas unterhaltsamer zu gestalten. Einer der Einspieler zeigte dann die beiden bei einer 'wilden Partynacht' in Las Vegas, die damit endet, dass Conan O'Brien filmreißend neben einer Hure aufwacht und Bill Gates neben... naja, siehe Bild eben.
Um nun aber zu den wirklich wichtigen Ereignissen der Keynote zu kommen:

During a demonstration of digital photography with a soon-to-be-released Nikon camera, a Windows Media Center PC froze and wouldn't respond to Gates' pushing of the remote control. Later in the 90-minute presentation, a product manager demonstrated the ostensible user-friendliness of a video game expected to hit retail stores in April, Forza Motor Sport. But instead of configuring a custom-designed race car, the computer monitor displayed the dreaded "blue screen of death" and warned, "out of system memory."

Und wie sahen Bill Gates diesmalige Zukunftsvisionen aus?

Wrapping up: the future. Chips are doubling in speed, storage is doubling in size. We’re releasing our technical limits; software will be more customizeable, and purposeful for new audiences. Grandma’s gonna use a computer in 2005? We’ll see, Bill. We’ll see.

Weitere Eindrücke zu Angelas Bills Keynote finden sich in einem Blog der Wirtschaftswoche (via wirres). Beinahe vergessen: Gates äußerte sich außerdem in einem CNET Interview zum Erfolg des iPod:

They had a hit with the Apple II, they had a hit with the Macintosh, and they have a hit with the iPod, so this is a company that's had three hits, and that's very impressive. There are a lot of companies that don't have three hits. And in the same way that Macintosh helped get people exposed to the graphical user interface, the iPod is doing a great job getting people to think about digital music. In the long run, there will be a lot of people making digital music players, and we think that there will be a very different market share with dozens and dozens of companies. And other than Apple, all those player makers are signing up to work inside the Windows PlaysForSure ecosystem.

Think Secret über Flash iPod Details [Update]

Klage hin oder her, Think Secret lässt sich momentan nicht bremsen. So wird heute ein flash-basierter iPod 'bestätigt' der in 1 und vermutlich 2GB Variante kommen soll. Preise dürften bei 149$ bzw. 199$ liegen. Wie schon breit in der der Gerüchteküche durchgekaut, soll der Chipsatz von SigmaTel kommen und bei Asustek zusammengebastelt werden. Nicht ganz sicher waren sich die Quellen beim Click-Wheel, möglicherweise besitzt der Flash iPod weitere Bedienelemente. Ebenfalls nicht klar ist die Verfügbarkeit, Produktionsprobleme könnten angeblich zu einer leichten Verzögerung führen.
Update: Heute morgen in Zeitknappheit vergessen: Laut Think Secret soll der iPod flash natürlich ein Display haben, in der selben Breite wie vom iPod mini bekannt, aber um zwei Zeilen verkürzt.
AppleInsider glaubt außerdem nach wie vor an den Flash iPod und sieht ein 1GB Modell als gesichert, das hauptsächlich auf dem asiatischen Markt beworben werden soll, bei einem Preis zwischen 129 und 149$.

Apple verklagt Think Secret [Update_3]

Nachdem Apple unlängst gegen das Asteroid Bekanntwerden sowie drei ADC Mitglieder die 10.4 Betas verteilten vorging, folgt nun die nächste Klage, die sich direkt gegen den Think Secret Herausgeber und 20 weitere unbekannte Personen richtet.

The suit, filed Tuesday in the Superior Court of Santa Clara County, Calif., aims to identify who is leaking the information and to get an injunction preventing further release of trade secrets. However, in filing the suit, Apple identifies specific articles that contain trade secrets, indicating that at least parts of those reports are on the mark.

CNET verspricht weitere Details in Kürze, solange darf spekuliert werden, ob der Anlass iWork oder 500$ iMac lautet.

Update: Das ging schnell, die Klage fand tatsächlich aufgrund von beiden Gerüchten statt. Zum 500$ iMac:

Apple says the article "disclosed numerous confidential details regarding the technical capabilities of Apple's unreleased computer product as well as Apple's confidential marketing plans."

Und im Zusammenhang mit iWork:

"The postings on Think Secret included detailed technical specifications and product code names," the lawsuit maintains. "Apple had maintained and protected this Future Product Information as trade secrets."

Zusätzlich werden die Informationen zu iLife 05 erwähnt und insgesamt Unmut über die kontinuierliche Gerüchteflut von Think Secret in den letzten Jahren geäußert. Als zusätzliche Problematik wird gewertet, dass Think Secrets Nick dePlume (dessen wahre Identität Apple nicht bekannt ist) Personen zum 'Geheimnisverrat' aktiv aufforderte.

Update_2: John Gruber hat sich Gedanken zur Klage gemacht:

You may disagree with Apple’s vigorous pursuit of leakers, but this is not a case of big bad Apple putting the screws to a little guy. Fried’s report at CNet makes it clear that Apple Legal has warned Think Secret (and, one presumes, other rumor mongers) repeatedly in the past few years.(...) If Think Secret wasn’t prepared for this, it’s because they’re foolish, not because they weren’t fairly warned.

Dan Gillmor ebenfalls:

If a company wants to control its own employees' activities, including by firing or suing workers who reveal secrets, that's a company's right. When it seeks to put a gag on the people who merely receive the information, that's going way too far.

Update_3: Nick dePlume äußerte sich erstmalig gegenüber Reuters zu der Klage:

"We're confident that Think Secret's reporting is consistent with the right and privileges granted by the First Amendment," dePlume wrote. "The complaint is being reviewed, and Think Secret defers further comment until it has been analyzed."
